This Agreement is a legal document which sets out your rights and obligations in relation to this site (the "Polosophia site") and the products offered by us through it (“Polosophia Products”). You must take the time to read and understand this Agreement before using the Polosophia site or making a purchase of an Polosophia Product; you accept that you are entering into a contract with us on the terms of this Agreement. You should be aware that this Agreement may change from time to time in accordance with Clause 11 below.

Please note that we reserve the right to withdraw the Polosophia site from time to time.
We understand that you may occasionally want to return items that are not suitable. If you are not satisfied with a product purchased from our online store, please return the goods within 14 days (or inform us of your intent to cancel your order within 14 days, in accordance with Consumer Contract regulations) to:

Items will be refunded providing that you do not use the item; it is in the same condition and full packaging as when you first bought it, complete with dust bag (if provided); and that you have taken reasonable care to ensure that any item is returned to us safely and not damaged in transit.
Unfortunately, shipping costs and/or import duties are non refundable and we are not held responsible for returns that do not reach us. In the event of the goods being faulty however, we would advise customers to contact us at firstname.lastname@example.org as soon as possible.
Please use the returns slip provided and send the parcel via a signed for service, please keep receipt for proof of postage. Please check carefully before returning any item.
Please note that we are no longer able to offer exchanges. If you would like to receive another item your return will be refunded and we kindly ask that a new order is placed online for the new item.
Any returned item that is received by us more than 14 days after the date of purchase will be not be accepted, unless in accordance with Consumer Contract regulations.
We may cancel an order at any time before delivery.
- Polosophia Product Details
Polosophia Products are subject to availability. If a Polosophia Product has become out of stock at a time when we receive the order, we will inform you, and you will not be charged for it. Items can be out of stock although displayed as in stock on the Polosophia site
At Polosophia, we endeavour to display as accurately as we reasonably can the true colours of Polosophia Products. However, we cannot guarantee that the colour of a Polosophia Product as delivered will replicate how it appeared to you on-screen; in part, this is dependent upon your computer’s display monitor, and how you perceive colour.
All sizes and measurements concerning Polosophia Products are as accurately as we can reasonably make them.
- Orders and Delivery
We will contact you if there is an excessive delay with the dispatch of your Polosophia Products.
Please note that all Polosophia garments are made to order, and can take 3-6 weeks to dispatch. We will keep you updated on your order expected delivery times.
We use professional delivery services, like UPS, DHL, DPD or similar for the sending and delivery of Polosophia Products; the total cost of your order will include a delivery charge. Delivery times will vary on service providers.
We reserve the right to decline to fulfill orders for any reason, including a Polosophia Product which has been mispublished, such as its price or specification. Orders are treated as offers which we are entitled to accept or decline. If there are any problems with your order, we will contact you.
There is only one delivery charge per order. Replacement Polosophia Product will be sent out free of charge.
We cannot arrange for deliveries of Polosophia Product to be left with a neighbour or similar requests; all deliveries must be signed-for at the delivery address you provide to us as part of your order. Note that we cannot be responsible for orders which go missing after delivery.
A maximum order of 5 of the same Polosophia Product may be made by any one person. Sale items are restricted to 1 of the same Polosophia Product per customer.
- Cancelling Your Purchase and our Returns Policy
Should we withdraw our Returns Policy or if there are Polosophia Products to which the Returns Policy does not apply, then your right to cancel an order will be governed by the remainder of this Clause 4.
You have the right to cancel your order for an Polosophia Product, starting from 14 calendar days following the first working day after the day on which you receive it. You can cancel your order for an Polosophia Product during this time by emailing email@example.com with a clear statement of your wish to cancel.
If you cancel your order during the 14 day cancellation period then you must return the Polosophia Product(s) to us at your own cost within 14 days of the date you cancelled. You must take reasonable care of the Polosophia Product while it is in your possession. If you cancel during the 14 day cancellation period and return the Polosophia Product in good condition, then you will receive a refund of all monies received, including the outbound delivery cost. If you fail to return the Polosophia Product in good condition to us within 14 days, then you will be responsible for payment of the price of the Polosophia Product. If you require a refund on a discounted Polosophia Product, please note that you will be refunded the discounted price.
Payments are processed at the time of ordering. Payment systems are supplied by and/or partners of Shopify.
Note also that all credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the card issuer does not authorise payment, we will not process the order.
When entering address details, please be aware there is a difference between the delivery address and invoice address areas of the order form: if your billing address (where your bank or credit card is registered to) is different from the desired delivery address, you must tick the box at the bottom of that page, and then continue to fill out the details of your billing address. Failure to complete this part of the order process may result in a 'warning' or 'caution' against your card.
All prices of Polosophia Products include VAT at the current rate. We do not exclude or refund VAT for any orders. You, as the purchaser, are responsible for any other taxes or duties (such as import duties) payable on Polosophia Products, not us.
You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to the Polosophia site and Polosophia Products are owned by, or exclusively licensed to, us. It is easy to copy material which appears on web-sites, but this does not mean it is legal. Therefore, no-one may copy, distribute, show in public or create any derivative work from the Polosophia site, an Polosophia Product or any of the material which is found on the Polosophia site unless properly licensed to do so by us.
We and or our affiliates may offer new or additional services through the Polosophia site from time to time. Your use of those services may be subject to additional terms and conditions, which you must comply with. Provided that those terms are notified to you on the Polosophia site in an appropriate manner (as determined by us in our reasonable discretion) when you agree to take those services, any failure by you to comply with a material provision of the terms governing those services will amount to a breach of this Agreement.
8.b. We shall be liable as expressly provided in this Agreement, but shall have no other obligation, duty or liability whatsoever in contract, tort (including negligence, breach of statutory duty and any other tort) or otherwise.
8.c. Nothing in this Agreement shall exclude or restrict our liability for death or personal injury resulting from our negligence.
8.d. Subject always to sub-Clause f. below, we shall be liable for direct loss or damage only, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise, and whether caused by its act or omission or that of its employees, agents or subcontractors. Our aggregate liability in relation to any Polosophia Product shall be limited to the price you paid for that Polosophia Product.
8.j. howsoever caused or arising, whether through non-supply or late supply of an Polosophia Product or other non-performance of this Agreement or otherwise.
8.f Except as expressly stated elsewhere in this Agreement, all representations, warranties, conditions and other terms, whether express or implied (by common law, statute, collaterally or otherwise) are hereby excluded, except in the case of fraud, or where such exclusion is not permitted by law.
8.g The provisions of this Clause 9 shall survive the termination or expiry of this Agreement.
This Agreement is intended to contain your entire agreement with us relating to the Polosophia site and Polosophia Products; we believe it to be fair and reasonable. It replaces all earlier agreements and understandings with you relating to the Polosophia site or Polosophia Products, except for any fraud or fraudulent representation by either of us. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.
10. Changes to this Agreement.
We reserve the right to change this Agreement from time to time, and post the new version on the Polosophia site. The new version will take effect for any activity on the Polosophia site, including any purchase of an Polosophia Product, after the new version is posted on the Polosophia site.
In the event that any term of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable.
This Agreement, and each purchase of a Polosophia Product, shall be governed by the laws of England and Wales and subject to the non-exclusive jurisdiction of the English courts.
13. Keeping this Agreement.
We don’t separately file the individual Agreements entered into by users of the Polosophia site. You can access it at https://polosophia.myshopify.com/pages/terms-and-conditions . Please make a durable copy of this Agreement by printing and/or saving a downloaded copy on your own computer. It is offered in English only.
The Polosophia site is provided, and Polosophia Products are sold and supplied through it, by Polosophia Ltd, whose address, for business conducted through the Polosophia site, is Unit 1 Cotton Mill, The Catwalk Place, Overbury Road, N15 6AQ, London. Please note that all notices under this Agreement are to be sent and received by email. For this purpose, your notices should be sent to firstname.lastname@example.org and we will send our notices to you at the email address you notify to us through the Polosophia site, such as when placing an order.
15. PRIVACY STATEMENT
SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SECTION 3 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

SECTION 6 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
